We may also ask you for information if you enter a competition or promotion or when you report a problem with the Giftie® Service, (ii)if you contact us, We may keep a record of that correspondence, (iii) We may also ask you to complete surveys that We use for research purposes, although you do not have to respond to them (iv)details of your visits to retail partner’s e-commerce websites, and the Giftie® Service including, but not limited to, traffic data, location data, weblogs, browser version, cookie details, how long you stayed on a page, your domain name and internet protocol (IP) address, operating system and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access, (v)  other data to ensure and check compliance with Our Terms of Use and/or otherwise as required by law. When you view content on the Giftie® Service, We may automatically collect and store certain information in server logs, including but not limited to internet protocol (IP) addresses, internet service provider (ISP), clickstream data, browse type and language, viewed and exit pages and date or time stamps.

The Giftie® Service may use cookies to distinguish you from other users of the Giftie® Service. The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information We hold about you. In the future we will make available functionality through our customer portal to view any and all data that we hold about you. In this case, no fee will be payable for exercising that service.

Any changes We make to our privacy policy in the future will be posted on this page. The new terms may be displayed on-screen and you may be required to read and accept them to continue your use of the Giftie® Service. Continued use of the Giftie® Service and any products or services provided by us will signify that you agree to any such changes.

General

The Terms of Use, and any other legal notices published by Giftie in the Giftie® Service or any end-user licence agreement in respect of any Giftie® Service offered by Giftie, will constitute the entire agreement between you and Giftie.

If any provision of the Terms of Use is deemed invalid by a court of competent jurisdiction, the invalidity of such provision will not affect the validity of the remaining provisions of the Terms of Use, which will remain in full force and effect.

No waiver of any term of this the Terms of Use will be deemed a further or continuing waiver of such term or any other term, and Giftie’s failure to assert any right or provision under the Terms of Use will not constitute a waiver of such right or provision.

The Terms of Use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. Any claim or dispute between you and Giftie that arises in whole or in part from the Giftie® Service will be decided exclusively by a court of competent jurisdiction in England and Wales.
